telegraph in oakland everything is very light so far no delay all the way through the caldecott tunnel from orinda in contra costa county. they have been doing a lot of roadwork on the richmond/san rafael bridge just east of it and this morning and every morning through friday they have that one lane blocked eastbound 580 approaching western. no big delays but they should re-open it by 6 a.m. and here's a live look at the bay bridge toll plaza. so far in the clear, no metering lights. back to you. the search is on for a san jose man missing since he headed for the sierra to mine for gold. 65-year-old walter steever left on his trip about a week ago today and hasn't returned home. kpix 5 reporter anne makovec joins us from the newsroom with what investigators have to go on. ann. >> reporter: not a lot. today is day 3 of a full-scale

search in nevada county. they have been searching for 24 hours for a man who mines gold for fun. 65-year-old walter stever left his home in san jose for a gold mining trip on october 23. >> this is a hobby he enjoys, comes here frequently. >> reporter: when he didn't return home over the weekend his wife called authorities monday. his car was parked in a fire lane in a rural area. around 100 volunteers are scouring more than 120 acres. the terrain is rocky and rugged. >> it's difficult, steep, as you can see very difficult to search. >> reporter: people who live in steever's west san jose neighborhood say he is a kind quiet man and resourceful always rend did i to lend a helping hand. >> i just hope he is okay, his family is okay, i'll say

prayers and hopefully everything will be okay. >> reporter: searchers are calling this a rescue mission not recovery so that's good news. they don't suspect foul play. >> thank you, anne makovec live in our newsroom. so while all this is going on, snow is blanketing the higher elevations up in the sierra. donner summit got over a foot of snow. no chain restrictions on 80 or 50 if you are heading up to tahoe. hundreds of people packed a church in santa rosa to mourn the death of 13-year-old andy lopez. friends and family carried the body of the teen killed by a sonoma county sheriff's deputy last week. the deputy thought lopez had a real gun but it was a pellet gun. >> i think that maybe being here in church might consolidate you for a few minutes but then the nightmare just will never go away ever. >> before the funeral hundreds of people had a peaceful march

in santa rosa to protest the shooting, another march is planned this afternoon. andy lopez's shoot something renewing an effort in sacramento. a california lawmaker might try again to get a bill passed that would require all toy guns to look like toys. state senator kevin deleon on the left originally made the proposal back in 2011. he would like fake guns to be translucent or brightly colored like this one. his earlier proposal failed after being opposed by the nra and toy companies. cbs reporter ben tracy asked deleon about that. >> i imagine that people who make these toy guns say the point is for them to look real and no one wants a gun that's bright pink or bright yellow or bright orange. what do you say to them? >> we're talking about children's lives. we're talking about lives that have been cut short unfortunately sadly by law enforcement because law enforcement didn't have the ability within a split nanosecond to discriminate between the real thing and a fake gun. >> federal law requires

imitation guns to have an orange tip at the barrel but it doesn't cover pellet guns like the one lopez was carrying. police departments are warning trick or treaters not to carry anything on halloween that could be mistaken for a weapon. campbell police say four shooting suspects appear in footage captured by a surveillance camera. it shows three men and a woman behind the man with a cowboy hat at the spot the nightclub orchard drive 2 a.m. saturday. investigators say one of the four shot an employee of the club after he asked the group to turn down their music in a parking lot. police say the victim is recovering. drunk driving is suspected in a deadly crash in sonoma valley last night. the chp says a jaguar veered into oncoming traffic and hit a toyota head on. a passenger into the jaguar was killed. all three people in the toyota were hurt including a 5-year- old girl. the collision blocked state route 121 for hours. the woman charged in the

dui crash that killed a menlo park couple is due in court this afternoon after her arraignment was put off for a second day. 54-year-old marjorie reitzell has missed two scheduled court appearances after complaining of chest pains. reitzell faces vehicular manslaughter and dui charges. she was on probation for a. dui conviction when police say she hit and killed kamal and balbir singh last thursday. reitzell's brother says his sister had a mental breakdown. alameda county sheriff's and fire departments will hold a news conference this afternoon with new information on the probe into a castro valley assisted care home. investigators say 14 patients were left with just a skeleton staff at the valley springs manor facility. the state shut down the facility last thursday citing a long list of violations including locking residents inside, inadequate amount of food and roaches and rodent droppings. a state assembly committee will hold a hearing next month

into the deaths on bart tracks in walnut creek. the chairman of the committee of labor and employment says the hearing is to get to the bottom of what happened earlier this month. the workers were struck by a train it that was operated by a trainee during the recent bart strike. two san jose city council members want to charge recruits if they leave the sj police department to go to another department. the idea is to make rookie officers pay the city back for training costs if they don't stay with the san jose department. the city is worried about losing officers to other cities because of lower pay and benefits for those new recruits. santa clara looking to hire more than 100 police officers for their new levi stadium. they will be on duty during the 49ers games, concerts, college games and, of course, the "super bowl l" in 2016. the pay for the part-time work, $55 an hour from revenues from the stadium. ac transit will come up with ways to increase ridership

it. kpix 5's brian webb in an exclusive report got up close to investigate. reporter: we shove off for treasure island, destination the mysterious floating google barge and the secrets that lie within. something even san francisco's own mayor admits he has no idea about. >> no, they kept the secret from me, as well. >> reporter: as we cruise up, almost close enough to touch, you can see cargo containers stacked four high with dark netting at one end on a barge some 250 feet long. theories range from a floating data center, retail store, a super secret laboratory, all the way to a floating paintball arena. the crew says they did some work on the project but are sworn to secrecy so we found our own expert an architect whose designed projects using shipping containers and building on water. >> at this scale for a floating structure it's the first i have heard of.

[ laughter ] >> thank you. oakland is trying to erase its graffiti problem. the city's tagging numbers are 60% higher than just a couple years ago. but as kpix 5's ryan takeo shows us, some businesses are drawing in muralists to fight the graffiti epidemic. >> i'm tired of fighting it. reporter: mike mccarthy was so tired of tagging outside his front door he paid $800 for muralists to paint this at the paint store. >> it's a paint store, not that type of paint but fitting i guess. >> reporter: mccarthy thinks that's a steal. >> saving me a lot of money in labor. >> reporter: once a week his

workers used to repaint the business's walls. mccarthy said it added up to $5,000 a year. >> we haven't had to repaint the building in three weeks. >> reporter: he has heard from critics who wonder if the taggers he hired sprayed here until his patience ran out. he hopes that's not the case and stands by the new walls. >> generally it's not the muralists that are going out and doing the vandalism? >> reporter: desi mundo is a muralist. his organization has spray- painted more than 100 projects all over oakland. >> the mural is the silence of violence. >> reporter: this one depicts the 131 murdered in city limits last year. mundo says the city is wasting money in abatement. oakland paid more than $1 million last year. mundo says that's just covering up graffiti short term. >> we need a more pro-active solution by involving muralist. >> reporter: for some frustrated businesses who are not afraid to pay up, murals could be the answer. in oakland, ryan takeo, kpix 5.

time. jericka duncan reports the math teacher's wife knew her husband tried to stop the shooter even before authorities told her what happened. >> i knew exactly what he did. i into you that he stopped it. >> reporter: when sharon landsberry first heard about the shooting at sparks middle school, she sent her husband a text message. he didn't respond. she had a feeling michael a marine in nevada air national guardsman had stepped in. police say a 12-year-old shot and killed the popular math teacher and coach as he tried to convince the boy to put down his weapon. >> he wouldn't want me to be angry. there's no reason to be angry. we lived a good life. >> reporter: three days before michael died, the couple celebrated their fifth wedding anniversary. before he left for work the morning of the shooting, he said these final words to his wife. >> have a good day, my beautiful wife. i can't wait to be home with you and go for our walk. i love you. >> reporter: sharon says almost every morning michael would put a sticky note on her coffee cup

usually in the 60s and the 70s, today, well, cooler than normal but comfortable. 68 in livermore and sunny skies. 60 degrees and cool in san francisco. and should be about 67 degrees in san jose. more on your forecast coming up. right now let's check your "kcbs traffic" with elizabeth. >> thank you, lawrence. now we go back to berkeley. this five-car crash is causing delays on the eastshore freeway westbound 80 before ashby, that accident five cars is blocking one of the middle lanes. it is beginning in the clear stages so they are working to remove it all off to the right- hand shoulder and a number of cars are already there but in the meantime, you can see the delays backed up to at least gilman and growing. and the drive time down the eastshore freeway looks like it's slow up to 25 minutes on westbound 80, carquinez bridge to the maze. at the bay bridge toll plaza, no delay. good across the span. this accident in antioch westbound 4 approaching somersville road is off to the right-hand shoulder. the delays are building behind it from at least "a" street.

bart would be a great option this morning because all the trains are all running on time. that is your latest "kcbs traffic." back to you. >> thank you. someone broke know a san jose elementary school and stole $70,000 worth of laptop computers and ipads, as well. more than 60 of those devices all taken over the weekend from the technology room at the river glen elementary school. parents spent years raising funds for the equipment. the value falls below the deductible so they won't be replaced immediately. police are hoping to speak to a tipster who may have some information on the death of that woman in san francisco's hospital stairwell. investigators say the man told a supervisor at the general hospital he saw someone lying in the stairwell october 4. that's 4 days later the body of lynne spalding was discovered. an attorney for the hospital told spalding's family the supervisor checked that stairwell that day but saw no

one. the "chronicle" is the latest major newspaper to stop using the name redskins for washington, d.c.'s nfl football team. there is a growing trend among publications and tv shows in refusing to use the team's name. some native americans find it offensive but the nfl will not change it. the team has won two games this year. they play the 9ers on the november 25. happening today, the nation's budget problems are back in the spotlight on capitol hill. house and senate negotiators will sit down for formal talks. they are aiming to reach a long- term agreement before the temporary budget expires january 15. less than half hour from now, a hearing will begin on capitol hill about the nation's trouble plagued healthcare website and as susan mcginnis reports, a top obama administration officials faces tough questions. >> reporter: health and human

services secretary kathleen sebelius will be in the hot seat today testifying in front of a house committee about problems with healthcare.gov. >> the president should ask the secretary of health and human services kathleen sebelius to resign her position because of the disastrous rollout of obamacare. >> reporter: in prepared testimony, secretary sebelius blamed contractors hired to build the website for the centers for medicare and medicaid services or cms. she says unfortunately a subset of those contracts for healthcare.gov have not met expectations. >> do you swear that the testimony you are -- >> reporter: but in testimony last week, those contractors said the real problem was with cms, which demanded last-minute changes and did not allow enough time to fully test the website. >> i want to apologize to you that the website has not worked as well as it should. >> reporter: marilyn taviner, the head of cms, says fixes since the launch have improved the website. >> you're saying the system right now is working? >> it's working, just not at

dublin interchange headlines towards the dublin interchange and 680, 21 minutes coming up over the altamont pass and through the livermore valley. there is an accident in tracy near 205 and 580. a motorcycle accident is blocking one lane. that's a little farther east obviously. here's a live look at our milpitas cam. westbound 237 in the clear between 880 all the way towards zanker road and continues to move well towards sunnyvale. and a little farther north in oakland 880 the nimitz this is near the oakland coliseum, oakland airport, taillights northbound and it's a smooth ride towards your downtown oakland exit. 16 minutes or so between 238 and the maze. there's still this accident it's there i just put it up because it is causing some slowdowns even though it is out of lanes. it is on the shoulder westbound 4 a little sluggish off the antioch bridge and really bottlenecks towards "a" street. once you get past somersville everything is cleared through pittsburg, bay point and concord and bart is fine with all the trains all on time. that is your latest "kcbs
